1. Eligibility

The Site is intended for use by individuals who are at least 18 years of age and legally able to enter into contracts. By using the Site, you represent and warrant that you meet these requirements.

2. Description of services

Through the Site, Company provides general information about its custom kitchen cabinet design, supply, and installation services in Maryland, and allows you to request a free in-home consultation or quote. The Site is informational and promotional in nature. Submitting a quote request does not create a contract for services. A binding services agreement is created only when both you and Company sign a separate written contract for a specific project.

When you press the "Get My Free Quote" button on the Site, your browser opens your own email client with the contents of the form pre-filled in a draft message addressed to kitchencabinetsmd@gmail.com. Your request is only delivered to us if you press Send in your email application. We are not responsible for messages that fail to send because of issues with your email provider, network, or device.

All content on the Site — including text, logos, brand marks ("Kitchen Cabinets MD," and the associated logo and design), photographs, illustrations, renderings, the catalog of cabinet styles, the design and arrangement of the Site, and all software — is owned by or licensed to Home Rise MD LLC and is protected by United States and international copyright, trademark, and other intellectual-property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Site's content without our prior written consent, except as expressly allowed by these Terms.

7. Testimonials, reviews, and gallery images

Photographs in the gallery and testimonials displayed on the Site represent actual or representative projects and homeowners. Testimonial wording may be lightly edited for clarity and length. Individual project results vary based on kitchen size, condition of the existing space, materials selected, and other factors. Past results are not a guarantee of similar results for any future project.

THE SITE AND ALL CONTENT, INFORMATION, MATERIALS, AND COMMUNICATIONS PROVIDED THROUGH IT ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

Cabinet products supplied by Company are covered exclusively by the warranty provided by the cabinet manufacturer for the specific style and product line installed; the manufacturer's written warranty controls and Company makes no warranty of its own as to the cabinet products beyond passing through the manufacturer's warranty. Any installation-services warranty applies only to projects covered by a signed customer contract with Company and is governed exclusively by the terms of that contract.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOME RISE MD LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THESE TERMS EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE TOTAL AMOUNTS YOU HAVE PAID TO COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE PRECEDING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless Home Rise MD LLC and its members, managers, officers, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to the Site; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any intellectual-property right or privacy right; (d) any claim that information you submitted caused damage to a third party; or (e) any willful or negligent act or omission by you.

11. Third-party links and services

The Site may contain links to third-party websites or services that are not owned or controlled by Company, including but not limited to financing providers, map providers, social media, and email services. Company has no control over, and assumes no responsibility for, the content, privacy practices, or practices of any third-party websites or services. You acknowledge and agree that Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

12. Force majeure

Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond its reasonable control, including without limitation acts of God, natural disasters, severe weather, fire, flood, war, civil unrest, terrorism, pandemic, government action, labor disputes, supply-chain interruptions, manufacturer delays, utility outages, or internet or telecommunications failures.

13. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing law and venue

These Terms and any dispute arising out of or related to them or your use of the Site are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict-of-laws provisions. Subject to Section 15, the exclusive venue for any judicial proceeding arising out of or relating to these Terms shall be the state or federal courts located in Maryland, and each party irrevocably consents to the personal jurisdiction and venue of those courts.

15. Dispute resolution — binding arbitration and class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the relationship between you and Company that cannot be resolved through informal negotiation shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Maryland, by a single arbitrator, in English. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Company agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Company each waive any right to a jury trial.

Exceptions. Either party may bring an action in small-claims court for disputes within that court's jurisdiction, or seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual-property rights.

30-day opt-out. You may opt out of the arbitration agreement in this Section 15 by sending written notice of your decision to opt out to kitchencabinetsmd@gmail.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other portion of these Terms.

16. Changes to these Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of these Terms. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site.

17. Severability

If any provision of these Terms is held by a court of competent jurisdiction or an arbitrator to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to reflect the parties' intent as nearly as possible and the remaining provisions shall continue in full force and effect.

18. Entire agreement

These Terms, together with our Privacy Policy and any written customer contract you and Company sign for a specific project, constitute the entire agreement between you and Company regarding the Site, and supersede any prior agreements or understandings regarding the same subject matter.

19. Assignment

You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign these Terms freely, in whole or in part, including in connection with a merger, acquisition, sale of assets, or by operation of law.
